Servotronics v. Rolls-Royce – A Panel Discussion of the Arguments and What the U.S. Supreme Court’s Upcoming Decision on Section 1782 Means for International Arbitration

The issue before the Supreme Court in Servotronics – whether 28 U.S.C. § 1782 allows parties to international commercial arbitrations to seek federal court orders granting U.S.-style discovery – has long generated animated debate within the international arbitration community, and the Court’s decision will have profound implications for international arbitration practice. This session will feature experienced 28 U.S.C. § 1782 counsel who will speak to the issues before the Court and the ramifications of the case.

Participants will vote at the end of the session on the following issue: “Whether the discretion granted to district courts in 28 U.S.C. §1782(a) to render assistance in gathering evidence for use in ‘a foreign or international tribunal’ encompasses private commercial arbitral tribunals?”
